By placing an order for products from this website, you accept and are bound by these Terms and Conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
You may not order or obtain products from this website if you fail to agree to these Terms and Conditions, are not at least 18 years of age, or are prohibited from accessing or using this website or any of its contents or products by applicable law.

1. Overview
These Terms and Conditions (“Terms”) apply to the purchase and sale of products through gusti.ca or us.gusti.ca (the “Website”) . These Terms are subject to change by Gusti International, Inc. (referred to as “us”, “we”, or “our” as the context may require) without prior written notice at any time, at our sole discretion. Your continued use of this Website after a posted change in these Terms will constitute your acceptance of and agreement to such changes and will apply to all orders made on or after the effective date of the new Terms. It is your responsibility to check this page periodically for changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.
These Terms are an integral part of the Website Terms of Use that apply generally to the use of our Website. You should also carefully review our Privacy Policy before placing an order for products or services through this Website.

2. Orders
You agree that your order is an offer to buy, under these Terms, all products listed in your order. All orders must be accepted by us or we will not be obligated to sell the product(s) to you. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. After having received your order, we will send you a confirmation email with your order number and details of the items you have ordered. Acceptance of your order and the formation of the contract of sale between Gusti International, Inc. and you will not take place unless and until you have received your order confirmation email. You have the option to cancel your order at any time before we have sent your order confirmation email by contacting our Customer Service Department at info@gusti.ca. See also Section 4(c) below for your right to cancel if we fail to deliver your order within a reasonable time.

3. Prices and Payment Terms
(a) All prices posted on this Website are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer by us and we reserve the right to cancel any orders arising from such errors. For orders shipping from Canada to the United States, see Section 4(d) regarding import duties.

(b) Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. We accept all major credit cards as well as Google Pay and Paypal for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

(c) This Website automatically detects your country based on factors such as your browser or device language, region settings, or IP address, and may direct you to the version of the Website — including the pricing and currency — applicable to that country. This detection relies on information outside our control and may not always reflect your actual location. The price and currency applicable to your order are confirmed once you enter your shipping address at checkout, and the price shown to you at that point is the price you will be charged. If you have any question about the price displayed to you, please contact our Customer Service Department at info@gusti.ca before completing your purchase. Once an order has been placed, we will not issue a refund or price adjustment on the basis of a difference between the price shown to you while browsing and the price confirmed at checkout. This paragraph does not limit any right you may have to a refund under Section 5 (Returns and Refunds) or Section 6 (Legal Warranty and Product Quality).

4. Shipments and Delivery
(a) We will arrange for shipment of the products to you. You will pay all shipping and handling charges specified during the ordering process.

(b) Risk of loss and title to the products pass to you upon delivery of the products to the address you provided at checkout.

(c) Shipping and delivery dates provided at the time of your order are estimates only, and minor variance from these estimates does not constitute a breach of these Terms. If we fail to deliver your order within a reasonable time of the estimated delivery date, you may cancel your order by notifying our Customer Service Department at info@gusti.ca before delivery occurs, and we will refund all amounts you paid within 7 days of your cancellation notice. This right is in addition to, and does not limit, any right you may have under the Consumer Protection Act (Quebec) or other applicable consumer protection legislation in your province or territory of residence.

(d) If your order ships from Canada to the United States, all applicable import duties are paid by us prior to shipping. The price shown to you at checkout is the final price for your order — no additional duties, brokerage, or customs processing fees will be added after checkout. If a discrepancy in duties or customs classification arises, we will contact you before your order ships.  If you are asked to pay an unexpected duty or customs fee to receive your order, please contact our Customer Service Department at info@gusti.ca; we will investigate and reimburse you for any duty or customs charge that duplicates what we have already paid.

5. Returns and Refunds (Change of Mind)
Except for any products designated on the Website as non-returnable or final sale, we will accept a return of the products for a refund of your purchase price, less the original shipping and handling costs, provided such return is made within 30 days of shipment and provided such products are returned in their original condition and have not been worn or used. This Section 5 applies to change-of-mind returns. If the product you received is defective, please see Section 6 (Legal Warranty and Product Quality) below — defective products are handled at no cost to you and are not subject to the shipping deduction described above.

6. Legal Warranty and Product Quality
Nothing in these Terms limits, excludes, or attempts to exclude any warranty, guarantee, or other right that cannot lawfully be excluded under the Consumer Protection Act (Quebec), the Civil Code of Québec, or other applicable consumer protection legislation in your province or territory of residence, including the legal warranty that products sold to you are free from latent defects and are fit for their intended use for a reasonable length of time, taking into account their price, the terms of the contract, and the conditions of their use.

If a product you purchased has a defect covered by this legal warranty, contact our Customer Service Department at info@gusti.ca. We will, at no cost to you and in accordance with applicable law, repair or replace the product or refund the purchase price, including any reasonable shipping costs you incur to return the defective product. Except as expressly stated in this Section 6 or as required by applicable law, we make no other express warranties regarding the products sold on this Website.

7. Goods Not for Resale
You agree to comply with all applicable laws and regulations of the various provinces of Canada. You represent and warrant that you are buying products or services from the Website for your own personal or household use only, and not for resale.

8. Privacy
We respect your privacy and are committed to protecting it. Our Privacy Policy, available at gusti.ca/policies/privacy-policy, governs the processing of all personal data collected from you in connection with your purchase of products or services through the Website.

9. Force Majeure
We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

10. Governing Law and Jurisdiction
All matters arising out of or relating to these Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any other jurisdiction.
Nothing in this Section 10 limits any right you may have to bring proceedings before the courts of your province or territory of residence, or any other mandatory protection afforded to you under the consumer protection legislation of your province or territory of residence, where such legislation applies and cannot be excluded by contract.

11. Assignment
You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section 11 is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.

12. No Waivers
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Gusti International.

13. No Third Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you.

14. Notices
(a) To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
(b) To Us. To give us notice under these Terms, you may contact us by email at info@gusti.ca, or by personal delivery, overnight courier, or registered or certified mail to Gusti International, Inc., 8484 L'Esplanade, Montreal, QC H2P 2R7, Canada. We may update the address or email for notices to us by posting a notice on the Website. Notices provided by email will be effective when sent to info@gusti.ca; if you do not receive an acknowledgment from us within a reasonable time, we recommend contacting us through another method listed in this Section 14(b) to confirm receipt. Notices provided by personal delivery will be effective immediately. Notices provided by overnight courier will be effective one business day after they are sent. Notices provided by registered or certified mail will be effective three business days after they are sent.

15. Severability
If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.

16. Questions or Complaints
If you have any questions or concerns about these Terms or an order, please contact our Customer Service Department at info@gusti.ca. If you are a resident of Quebec and believe we have not complied with the Consumer Protection Act, you may also contact the Office de la protection du consommateur.

17. Entire Agreement
Our order confirmation, these Terms, our Website Terms of Use and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
